These General Terms and Conditions ("Terms") apply to every order placed by a visitor of this e-commerce webshop ("Customer"). Additional terms from the Customer are excluded, unless they have been explicitly accepted in writing in advance. Article 2: Price All prices are expressed in euros and, unless otherwise stated, include VAT. If delivery, reservation, or administrative costs are charged, this will be mentioned separately. The price listing applies only to the items as described. The accompanying photos are for decorative purposes and may contain elements not included in the price. Article 3: Offer Despite the fact that the online catalog and the e-commerce webshop are compiled with the greatest possible care, it is possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer are not binding. The seller is not liable for apparent material errors, typographical or printing errors. If the Customer has specific questions about, for example, sizes, color, availability, delivery time, or delivery method, we ask the Customer to contact our customer service in advance. The offer is valid as long as stocks last and can be adjusted or withdrawn at any time. The seller cannot be held liable for the unavailability of a product. Article 4: Online Purchases The Customer has the choice between payment by bank transfer or credit card. The seller is entitled to refuse an order due to a serious shortcoming of the Customer regarding orders involving the Customer. Article 5: Delivery and Execution of the Agreement Any visible damage and/or qualitative deficiency of an item or other shortcoming in the delivery must be reported by the Customer immediately. The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has physically received the goods. Orders are processed within 5 working days (working days are Monday - Friday) unless otherwise indicated in the shipping method or due to closure for holidays or vacation periods. Closure for vacation periods will always be clarified on the webshop. The standard delivery term is a maximum of 30 days, but in exceptional cases, the delivery term may be longer. An exceptional situation may be that the products are not in stock. If the delivery term exceeds 30 days for this reason, the customer will be informed. If any other reason affects and extends the delivery term beyond 30 days, the customer will be directly informed. Article 6: Retention of Title The delivered items remain the exclusive property of the seller until fully paid by the Customer. Article 7: Right of Withdrawal The provisions of this article only apply to Customers who, in their capacity as consumers, purchase items online. The consumer has the right to revoke the agreement within 14 calendar days, unless otherwise specified, without giving any reason, provided that the right of withdrawal applies to the goods or services ordered by the customer. To exercise the right of withdrawal, the Customer must inform the seller in an unequivocal statement (e.g., in writing by mail or email) of his decision to revoke the agreement. The Customer must return or hand over the goods immediately after deciding to revoke the agreement. The direct costs of returning the goods are borne by the Customer unless otherwise agreed. If the returned product is somehow reduced in value, the right is reserved to hold the Customer liable and claim compensation for any depreciation. Only items in their original packaging, including all accessories, instructions, and invoice or purchase proof, can be returned. In the case of service agreements, if the Customer has requested the performance of services to begin during the withdrawal period, the Customer pays an amount proportional to what has been delivered at the time the Customer informs us of the withdrawal compared to the full execution of the agreement. Article 8: Warranty Under the law of 21 September 2004 on the protection of consumers when selling consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. To invoke the warranty, the Customer must present proof of purchase. The (commercial and/or legal) warranty never applies to defects arising from accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, non-compliance with instructions or manual, modifications or alterations to the item, rough handling, poor maintenance, or any other abnormal or incorrect use. Article 9: Penalties for Non-Payment Without prejudice to the exercise of other rights, the Customer, in case of non-payment or late payment, owes interest on the unpaid amount from the date of default by law and without notice. Without prejudice to the foregoing, the right is reserved to take back the unpaid (fully) items. Article 10: Affecting Validity - Non-Waiver If any provision of these Terms is declared invalid, illegal, or void, this shall in no way affect the validity, legality, and applicability of the other provisions. The seller's failure at any time to enforce any of the rights enumerated in these Terms or to exercise any right hereof will never be considered a waiver of such provision and will never affect the validity of these rights. Article 11: Modification of Terms These Terms are supplemented by other terms explicitly referred to, and the seller's general sales conditions. In case of contradiction, these Terms prevail. Article 12: Applicable Law Belgian law applies. The courts of the seller's place of residence are competent in legal disputes. The seller may also refer to the ODR platform.
